TERMS OF SERVICE

Welcome to www.ConnectionToGo.com ("we", or "us" or "ConnectionToGo.com" or "ConnectionToGo" or "Website" or "the site"). ConnectionToGo is running a wireless broadband card rental business ("service" or "Services"). This service is operated by Monira WorldWide Group, LLC. (DBA ConnectionToGo). By using or visiting the Website you accept and agree to be bound by the following terms of use (the "Agreement"). In case you ("you" or "renter") do not agree with any of the terms or conditions, you should stop using the site immediately. The Agreement includes the Privacy Policy and any notices regarding the Website or the Service sent to you or posted on the Website. In addition you will also comply with any law applicable to the use of this site. Any terms or conditions may be modified by us at any time without prior notice. All such modifications will be effective upon posting on ConnectionToGo.com , and any use by you of the Website or the Service after such modifications will constitute your agreement to the modified terms. You should therefore regularly review these terms and conditions.

You may also accept the Agreement by word or action including but not limited to (a) by signing an Agreement with us; (b) clicking on "I accept" on this website; (c) using the Services in any manner whatsoever or even by attempting to do so; (d) by making a payment for Services; or (e) accepting delivery of any item sent by us (f) installing any program in your or any other computer for use by yourself or anybody else.

Terms may also be modified in the sole discretion of ConnectionToGo, when the wireless broadband card ("Device") is issued to you.

  1. The Website may contain links to third party websites that are not owned or controlled by ConnectionToGo. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, we will not and cannot censor or edit the content of any third-party site. By using this site, you expressly relieve ConnectionToGo from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to be aware when you leave the Website and to read the terms and conditions and privacy policy of every website that you visit.
  2. By agreeing to these terms or by using the Website, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. If you are not an individual but represent an entity, you represent and warrant that you have the authority to enter into this Agreement on behalf of the said entity.
  3. Agreement & its termination - Unless terminated by either party as per the terms of this Agreement, it shall remain in full force and effect while you use the ConnectionToGo and/or the Services. You may terminate your account at any time, for any reason, by following the instructions, or by sending an email to Info@ConnectionToGo.com. You agree that we may, under certain circumstances and without prior notice, immediately terminate your account, or and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of this Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you, (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Further, you agree that all terminations for cause shall be made in ConnectionToGo's sole discretion and that ConnectionToGo shall not be liable to you or any third party for any termination of your account, or access to the Service.
  4. Some provisions of the agreement will remain in effect even after your account is terminated.

SHIPPING, DELIVERY AND RETURN

  1. In order to access the wireless broadband service from Sprint, AT&T or Verizon. A broadband card ("Device) will be sent to you. The Device shall be delivered on or before the date of commencement of service, to the address provided during the ordering process. We do not ship to Post Office Box addresses. You agree to accept the shipment, any failure to accept the shipment will result in charges for the period per the scheduled rate in which the package is in transit back to our office. In the event the device is delivered before the agreed date of rental, the renter will only be responsible for data overage charges. Daily charges will start on the agreed upon date. While every care is taken to ensure timely delivery of the Device, ConnectionToGo shall not be liable for any misdelivery or late delivery of the device.
  2. The Device should be returned in the envelope or packet provided for the purpose and should be either deposited with one of our authorized shipping agents or sent as per instructions given on the website or communicated to you.

SOFTWARE INSTALLATION AND SUPPORT

  1. Renter will be required to install software from a wireless broadband provider (Sprint, Verizon, or AT&T). The software will be made available in the packaging with the device or on the website.
  2. Support will be provided in the setup of the device by emailing support (Support@ConnectionToGo.com) or calling the phone number listed on the website. ConnectionToGo will put a good faith effort into responding to support inquiries in a timely manner.

DEFECTIVE OR LOSS OF DEVICE

  1. Renter shall check the Device on receipt for any defect or malfunction. Any such problem should be immediately communicated to ConnectionToGo (Support@ConnectionToGo.com), and the Device should be immediately returned to us as per instructions conveyed to you from a ConnectionToGo representative. ConnectionToGo will, if it is satisfied, shall send a replacement for any defective Device, and shall also waive any charges for the length of time it takes for you to receive a replacement. You understand that any delay by you in communicating the information to ConnectionToGo, shall result in levying of charges as applicable. You should also not attempt to repair any Device or temper with it as it will result in forfeiture of your deposit of $250, in addition to the charges for the service period being levied on you.
  2. In case of loss of the Device or any part thereof, the deposit of $250 shall be forfeited. The deposit may also be forfeited in case of Device being returned in a damaged condition. Proper care of the Device while it is in your custody is entirely your responsibility.

GEOGRAPHIC LIMITATIONS

  1. Usage of the device is restricted to the continental United States. For specific information regarding geographic limitations at the location where you intend to use the device, refer to the coverage map link posted on the FAQ page.

RATES AND FEES

  1. Rental Rates: Daily Rental rates are based on a 24-hour rental day starting on the date agreed  upon by the renter during reservation or at the time shipment is accepted (as verified by online tracking provided by the shipping company - USPS, UPS, or FedEx). The renter will be charged for each 24 hour period until the device is returned (accepted by the shipping company). If the renter fails to comply with the conditions applicable to the rate, including any geographic restrictions, surcharge or other rates may apply.
  2. Renter will pay the rental rate posted on the website at the time of reservation for the period the device is rented.
  3. Rental rates will be adjusted if the device is returned early or kept longer than the original reservation rental period based on rental rates at the time of reservation.
  4. The charges are payable till the latest of the following: (i) period for which the Device has been issued to the Renter (Rental Period), (ii) the Device is returned to the ConnectionToGo, and is accepted by its authorized representative; (iii) the charges are payable for a minimum of 3 days period.
  5. For every week of the agreement, you will be allotted a total of one gigabyte (1 GB) of data upload or download, both combined and taken together not to exceed this limit. Additional charges shall be levied for any usage above this limit; $.15 (15 cents) per one megabyte (1 MB). 
  6. Rental rates may change without prior notice. Current rates will be posted on the site, pricing changes occur from time to time so we suggest that you check the rates before placing an order.

CREDIT CARD CHARGES AND AUTHORIZATION

  1. You will be required to give details of your credit card when reserving the device(s). We will only accept MasterCard, Visa and Discovery credit cards. Debt cards are not accepted.
  2. ConnectionToGo may seek authorization of your credit card account upon submitting a reservation; renter authorizes ConnectionToGo to authorize the credit card for debiting the estimated applicable charges + $250. This is not a charge but may appear to reduce your available balance by the authorization amount until your credit card's next billing cycle. Contact your card issuer if you have additional questions regarding when this amount will be removed from your statement.
  3. The credit card will be charged immediately the invoiced amount. Renter authorizes ConnectionToGo to charge the credit card for all charges incurred prior to invoice date.
  4. The charges include, but are not limited to charges for shipping and return of the device, applicable taxes, cancellation charges, charges for any damage or loss of either the Device or any part thereof, charges for excess use or delay in return of the Device.
  5. The charges are payable whether the Device is used or not.

TERMINATION

  1. ConnectionToGo reserves the right to deactivate internet service for any reason without prior notice.

Use of Spyware etc. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that accesses the Website in a manner that sends more request messages to the ConnectionToGo servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, ConnectionToGo grants the operators of public search engines(like Google, Yahoo, MSN) permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. ConnectionToGo reserves the right to revoke these exceptions either generally or in specific cases.

The content on the Website,  including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to ConnectionToGo, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Content on the Website is provided to you on AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the owners. ConnectionToGo reserves all rights not expressly granted in, and to, the Website and the Content. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, for any commercial purposes. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Website or the Content therein.

You agree to indemnify and hold ConnectionToGo, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any alleged claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your use of the Service, your connection to the Service, your violation of the Agreement, or your violation of any rights of another, whether you are a registered user or not. The user is solely responsible for his or her actions when using the Service.

ConnectionToGo and its affiliates, licensors, partners, suppliers, consultants and disclaim any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information, or Content displayed, or the Service. The ConnectionToGo disclaims any and all responsibility and liability for your conduct and for the conduct of others using the Service. THE SERVICE, AND ALL CONTENT, INFORMATION (INCLUDING, WITHOUT LIMITATION, ANY INFORMATION OR CONTENT OBTAINED OR ACCESSED THROUGH THE SERVICE), PRODUCTS AND SERVICES INCLUDED THEREIN ARE PROVIDED "AS IS," WITH NO WARRANTIES WHATSOEVER. THE CONNECTIONTOGO ENTITIES EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. Some states do not allow the exclusion or limitation of implied warranties, so the above disclaimers and exclusions may not apply to you. YOU AGREE THAT YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.

These Terms of Use will be governed by and construed in accordance with the laws of the State of Washington, without giving effect to its conflict of laws provisions or your actual state or country of residence. The parties agree to submit to the personal and exclusive jurisdiction of the courts located in Seattle, State of Washington, the United States of America. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Use to be unenforceable, the remainder of the Terms of Use will continue in full force and effect. You shall not assign this Agreement or assign any rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without our prior written consent. Any such purported assignment or delegation will be null and void and of no force or effect.

Without limiting the foregoing, under no circumstances shall ConnectionToGo be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties.

These Terms of Use constitute the entire agreement between you and ConnectionToGo with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Use by a party will be effective only if in writing.
